Gym House Rules
Please note that these House Rules form part of your Northern Arena Membership Agreement. They form part of our club rules and may be changed without notice. Breach of these House Rules may result in termination or suspension of your Membership Agreement. If your Membership Agreement is terminated as a result of your breach of these House Rules, you may also be prevented from re-joining Northern Arena in the future.
HEALTH AND SAFETY

You must always follow Northern Arena’s Health and Safety instructions and requests from Northern Arena staff, otherwise, you may be asked to leave the premises.

Please wear clothing that is appropriate and comfortable to exercise in – no jeans, bare chests, bikinis, or items of clothing that are offensive or intimidating to others.

Please ensure you are fully dry before leaving the pool halls.
-
Please wear appropriate sports footwear. No open-toe footwear. Bare feet are allowed only in classes that require it.

Towels are compulsory in workout areas. If you have forgotten your towel, you can buy one at reception.

You are expected to clean up after yourself and wipe down all equipment after use.

Please do not enter the premises under the influence of drugs or alcohol. Anyone who does will be asked to leave immediately and may have their membership terminated.

Please do not enter the premises if you are feeling unwell.
-
You are not permitted to train or coach others in our clubs unless you have authorisation from Northern Arena to do so.

Your gym access card is for your individual membership only – Do not use your tag to gain access into Northern Arena for another person.
YOUR PERSONAL BELONGINGS

It’s up to you to keep your belongings safe

Please keep bags off the gym floor and do not bring your bags to class. Leave all your gear in the lockers provided.

Please leave your gear in the lockers and use a padlock while working out. Please take your gear home every night.

Clothes on. What you wear during training is up to you. What you don’t wear however, is a subject of contention. Guys, we know you’ve worked hard, but keep your tops on during your workout please – give that 6-pack some exposure at the beach.
PHOTOGRAPHY IN CLUB

Do not photograph or video anyone on club premises without the express prior consent of every single person who may be in the images, whether staff, Personal Trainers or members.

Do not post online, broadcast, stream or publish any photos or videos which contain an image of any person other than you or someone who has given you permission to post this image.
-
If members or guests want to use any photo or video taken on club premises for commercial purposes, they must get written permission from Northern Arena Management.
-
Northern Arena staff and contractors may take photos or video recordings for the purposes of providing services to members, social media, or advertising. Where Northern Arena staff or contractors take such photos or recordings, they must abide by all relevant Northern Arena policies.

Strictly no photos or videos in the changing rooms
POOL
-
Caps must be always worn while in the pool.
-
Please wear swimwear that is appropriate and comfortable to exercise in.

Please follow the guidelines of your Swimfit instructor regarding swimming direction and lane usage.

For everyone's safety ensure you are fully dry before leaving wet areas (no moving between the pool hall and gym changing rooms whilst wet).
THE HEAVY STUFF

Do not bring illegal or banned performance-enhancing substances of any kind on or around facility premises.
-
Do not carry out (or attempt to carry out) any illegal activity in or near our facility.
-
Do not behave inappropriately or offensively, particularly in the changing rooms.
-
Do not use abusive language or harass, insult, or threaten anyone (staff or members). We will terminate the membership of anyone who causes other members or staff genuine concern about their safety inside or outside the club (that includes emails, texts, phone calls or correspondence).

Do not solicit members or carry out any business, promote products or services within the club. This includes contacting members or staff by email for business purposes without their consent.
-
No Gang Patches or Gang-related clothing.
CHILDREN

The minimum age for a gym membership is 13 years.
-
Children between the ages of 13 and 18 (inclusive) require consent from a legal guardian to become a gym member or use the club facilities on a casual basis.

From time-to-time Northern Arena may work together with schools or clubs to offer supervised exercise programmes. The terms of any child's access and use of Northern Arena’s facilities for the purposes of any school or club programme will be as agreed between Northern Arena and the relevant school or club.
COMPLAINTS PROCESS

If you have any concerns or complaints about a service, a staff member or a facility, please speak to reception and we will put you in touch with the appropriate manager.

We may ask you to put your complaint in writing.

By using the Website, and purchasing any products from the Website, you will be deemed to agree to the Terms and Conditions of Website Usage as well as the [Online Shop Terms and Conditions] set out below. Northern Arena is located at Northern Arena, 8 Polarity Rise, Silverdale, Auckland and we specialise in learning to swim, health and fitness and supplying Speedo swim-wear, Manuka Doctor, Sting, Myzone, and more accessories and are committed to making online retail an enjoyable and simple experience.
All items are displayed in New Zealand Dollar, NZ$.
Placing an Order
Ordering online is easy. You simply place the items you require in your shopping basket by clicking on the Buy button whenever you see an item you would like to buy. Adding an item to your basket does not commit you to buy as you can always remove it later. You can review the contents of your basket at any time by clicking the Your Shopping Cart link. Once you have found all the items you need, go to the checkout, and pay for your purchases. Following the simple instructions given there when you have completed the check-out details, you will be shown a Final Order Summary.
Once this information has been entered you will be transferred your preferred payment method of debit/credit card (either Locally hosted Stripe or Paypal) secure payment gateway, where you will then need to enter your payment details including credit card details and your full billing address.
Please note that any goods purchased on the Website must be for personal use only and must not under any circumstances be purchased for commercial purposes or distributed commercially.
Acceptance of Orders
All orders are subject to acceptance by Northern Arena. We will notify you of our acceptance of your order by e-mail shortly after we receive it. At this point, a binding agreement will be created between us in accordance with this Customer Service Agreement. If the product you want is out of stock or the price of the product has increased between the time of the order and our acceptance of it, we will e-mail you to advise you of the change in price or when more stock is due. You will then need to confirm to us whether you wish to proceed with your order.
Clerical Errors
Northern Arena uses all reasonable endeavours to ensure that all information on the Website is accurate. In the unlikely event that an incorrect price is displayed in relation to any product on this site due to a clerical, typographical, or pricing error, Northern Arena shall have the right to refuse to accept any order or cancel any contract to supply such product whether or not the order has been confirmed and the credit card has been charged. If a credit card has already been charged for the purchase and the order is cancelled for this reason Northern Arena shall issue a credit to your credit card in the amount of the incorrect price within 5 working days.
Listing and Descriptions
Northern Arena makes every effort to ensure that the product descriptions and photographs provided on the Website are accurate. Whilst the reproduction of colours and styles contained on the photographs shown on the Website are as accurate as image and photographic processing will allow, Northern Arena does not accept responsibility for slight variances in colour or style.
Pricing and payment
All pricing shown is in New Zealand Dollars. GST (Goods and Services Tax) at 15% is included within the price. Northern Arena will not cover the cost of these charges or accept responsibility for any currency conversion charges.]
We accept Visa and MasterCard. Please note, your card payment is processed by either Stripe or Paypal. Goods will only be dispatched once full payment has been received and funds have been cleared – this may take up to four days, however typically two days with Visa and MasterCard.
Northern Arena is proud to be associated with Stripe or Paypal, Northern Arena does not collect or store any credit card information. This information is all processed by Stripe or Paypal. When making a purchase you will be directed to a secure webpage hosted by either Stripe or Paypal to enter your payment details. These hosted payments page is secured using SSL.
SSL (Secure Sockets Layer) is a method of ensuring that information submitted through your Web site is secure and cannot be accessed by unauthorized users. When a site offers an SSL-secured form, the information submitted via that form (typically credit card information) is encrypted using a special certificate key and then decrypted with another key after it has been transmitted. Delivery
Northern Arena will deliver to New Zealand addresses only. Northern Arena endeavours to despatch all orders within 5 working days. All goods are delivered by Post Haste. Delivery to all other countries outside of New Zealand is currently not available. Northern Arena cannot be held responsible for delays that may occur during transit. Northern Arena accepts no liability for undelivered goods sent via Post Haste, a refund will not be processed if the mail is lost, undelivered, or stolen.
Postage Costs
These are calculated using your delivery address, weight, and size of the item. Follow the instructions on the website to see your total packaging & carriage costs.
[All international packages are sent international economy courier with New Zealand Post at a minimum charge for a package of weight at 1kg. For parcels above 1kg, the rate will vary. Northern Arena will inform you of these costs prior to dispatch. Go to www.posthaste.co.nz for exact rates. Any charges or customs entry fees charged on entry to the delivery address entered on your order are your sole responsibility.]

Northern Arena will not guarantee the delivery or refund of any non-deliveries due to Customs not accepting the parcel.] All packages [(within New Zealand and international)] are delivered door to door and require a signature upon delivery. Track and Trace are standard for all packages. All packages are targeted for delivery between 2 – 6 working days.
Returns Policy – Your Right to Return and Exchange Goods
If you are not 100% satisfied with the items you have ordered, please email us at shop@northernarena.co.nz and let us know the reasons for your dissatisfaction. If you return your order to us in accordance with our Return Conditions below, we will be happy to offer a full refund or exchange the goods for another item.
Please note the following conditions apply to all returns “Return Conditions”:

Items must be returned to us within ten days of the date on which you received the item.

We will not refund your return delivery costs.

We will only accept goods returned with prior notification through correspondence with our sales department at shop@northernarena.co.nz/

We will not accept any goods that have been worn, used, have their labels removed, resized, engraved, altered or damaged. Please note that health regulations stipulate that swimwear that is soiled, damaged, worn or laundered is considered to be in other than “As New” condition and cannot be returned. Please remember that the regulations require swimsuits to be tried on over undergarments.

We can only accept items returned if they are within their original packaging.

There is no return or exchange for sale items
Northern Arena guarantees all products purchased from our online store to be free from defects. We will gladly replace defective items or issue a credit for any defective items you wish to return. Manufacturing defects do not include normal fair wear and tear and any damage caused by accidental or non-accidental damage. Notwithstanding the bullet points set out above, if your product has a manufacturing defect, we will refund your postage costs, and accept the return, even if it is a sale item. Depending on the nature of the defect, we may also waive our requirement that the good be returned within 10 days.
We strongly advise you to check goods thoroughly upon delivery before removing any attached tags.
Northern Arena reserves the right to turn down a return at our discretion if the above Return Conditions are not met.
Exchange Policy
In the event of an exchange, items are subject to product availability. You will be responsible for any delivery costs for returning items to be exchanged. We can only exchange an item for a different style and colour subject to our stock availability. All exchange enquiries can be made by contacting shop@northernarena.co.nz/ with EXCHANGE in your subject heading. Exchanged items can only be dispatched after the returned goods have been received in accordance with our Returns Conditions and undergone a quality control check back at head office. Please be aware that you may incur an additional delivery charge for the delivery of the replacement item.
Receiving a Refund
Once your package has been returned to us within the above stated time frame, unless otherwise authorized by the directors at Northern Arena, we will begin to process your refund request. Each item will undergo a quality control check and once verified your refund for all items that satisfy our Return Conditions will be credited to the original purchaser’s credit card including GST, excluding courier charges. You will be notified via email to the address listed on your account when the transaction has taken place. Please note that your bank institution may require additional days to process and post the transaction to your account once they have received the information from Northern Arena.
Please note: if we receive your return in a condition which we feel is not fit for exchange or refund we shall get in touch with you to discuss next steps. Northern Arena reserves the right to refuse a return or exchange for any item sent back in a condition that does not satisfy our Return Conditions. Only items which Northern Arena can confirm satisfy our Return Conditions will be eligible for a return or exchange, so that they have reached our returns department within the time frame outlined above (unless otherwise arranged with and agreed to by Northern Arena.
Gift Returns
If someone has sent you a special gift from Northern Arena but it wasn’t quite right, then provided that you comply with our Return Conditions, you can return it in exchange for a credit note which you can use to redeem on our Website. A Northern Arena credit note will allow you to select a replacement item / items from our Website for a period of one month. When you wish to redeem your credit note, please get in touch with our head office to organize an online purchase with your credit note.
Manufacturer’s warranties
If a product you have bought comes with a manufacturer’s warranty or guarantee, and the quality is questionable, and/or becomes deteriorated before the warranty runs out please contact Northern Arena through our contact us page, as we will ensure that either your product is fixed or replaced in accordance with the manufacturer’s promises.

New Zealand Law
Any goods supplied or sold by Northern Arena Limited, are sold or supplied under New Zealand law and users submit to the jurisdiction of the New Zealand courts.
Our Liability Responsibilities
No claim against us:
Northern Arena will not be liable:

for any loss or damage of any kind whatsoever to your personal property which you bring into the facility, or onto the premises, at your own risk (excluding where such loss or damage is due to Northern Arena’s negligence).

for any loss or damage of any kind whatsoever to you or your personal property which has been caused by a third party (such as a personal trainer, physiotherapist, or another visitor/ member) who is not connected with our services and facilities that we provide to you.

for any loss or damage of any kind whatsoever to you or your personal property which has been caused by events that are beyond our control and that could not have reasonably been foreseen or prevented; or

for any closure or failure to provide or offer services because of events beyond our control.
Limitation of liability:
In no event shall either party be liable to the other for any consequential or indirect losses.
Risk of injuries and release of liability:
We warn you that, while on our premises, you or child under your care may be exposed to certain risks. By entering into a service agreement and on every occasion, you or child under your care use our facilities and you or a child under your care participate in an exercise or fitness programme, learn to swim lesson, or any other activity, you acknowledge and accept our warning of risk of injuries set out above and that you or child under your care is subject to the risk of injury.
Third Parties
We use third parties to provide some services in our club, such as personal training, group fitness classes and physiotherapy. We are not responsible for those services provided by third parties.
Claims against a third party: If you are unhappy with the service you have received from a third party and wish to make a claim, your claim should be brought against the third party, not us. We will not be liable for any claim resulting from an act or omission by a third party.
Our support: Where possible, we will help you to resolve any issue you may have with a third party at Northern Arena and request that you notify us before contacting the third party. We require that personal trainers, group fitness instructors and physiotherapists in our facility are qualified.
